Synopsis

In Poland, local government administration is one of the areas of social life considered to be one of the most threatened criminal activities such as corruption, fraud, theft and misappropriation of property. The commune, as a local government unit, works in direct contact with people, which makes it particularly vulnerable to criminal activities that may be committed to its detriment. Not only her property is exposed to criminal activities, in particular, processes in which one or a small number of people make decisions are exposed. A commune as a self-government unit, in the event of injury, becomes a participant – a party to the preparatory proceedings and in this type of external relations it is represented by the head of the commune (mayor, city president). As the authority, he will be the one who will notify about the crime committed to her detriment and participate in the preparatory proceedings on behalf of the commune. The provisions of the Act on municipal self-government in the part relating to its executive body indicate and specify the duties and legal position of the commune head.
